However, Additional Commissioner of Police (Traffic) B Dayanand said, “The accused is absconding and he is not at NIMHANS.” <br /> <br />The accused had tried the same trick even in previous cases booked against him. Sources also said he is trying to get anticipatory bail and attempting to frame one of his workers in this case. <br /> <br />Dayanand made it clear that the police will book the accused under Section 304 of Indian Penal Code (culpable homicide not amounting to murder). <br /> <br />“In accident cases, the accused are normally booked under Sec. 304 (A) of IPC (causing death by accident), but, in this instance, we have booked the case under Section 304 IPC, which is a more stringent section,” the officer said. <br /> <br />Material seized from the vehicle and circumstantial evidence are enough to prove that the accused was under the influence of alcohol and that he was driving the vehicle recklessly leading to the accident, Dayanand maintained. <br /> <br />He, however, refused to give any details about the seized material. <br /> <br />An officer of the rank of Assistant Commissioner of Police (ACP) is heading a team that is probing the case.
