Presidenti i Republikës ka te gjitha mundësitë ligjore te zgjedhe ne detyrën e zëvendëskryetarit te KLD një prej 9 gjyqtareve qe janë pjese e këtij Këshilli. Ky është opinioni i anëtarit socialist te Komisionit te Ligjeve, Armando Subashi, i cili i referohet ligjit për KLD për te mbështetur argumentin e tij. Zoti Subashi, i cili me herët ka qene një nder gjyqtaret anëtarë te KLD, thotë se vendimi i Gjykatës Kushtetuese, ndryshe nga sa pretendon kryeministri Berisha, nuk ka prekur këtë nen te ligjit. Me tej juristi Subashi sjell edhe një argument politik, për te mbështetur idenë se nëse Presidenti do te ishte i kushtëzuar te përzgjidhte një nga 3 emrat e votuar nga Kuvendi, atëherë cenohet pavarësia e KLD. Pas largimit te Kreshnik Spahiut nga detyra e numrit 2 te KLD, Presidenti Topi përzgjodhi gjyqtarin Ilir Mustafaj për këtë post. Votimi është shtyre për javën e ardhshme.
