Garda ka tejkaluar kompetencat pasi ka qëlluar ne drejtim te turmës me armë luftarake. Ish-kreu i Policisë Bashkiake, Zyhdi Dajti, ka bere këtë deklarate, pas dëshmisë që ka dhëne ne Gjykatë ne procesin për "21 Janarin". Për rreth 60 minuta, Dajti ka rrëfyer para Gjykatës ne lidhje me ngjarjen e rende te 17 muajve me pare, ku mbeten te vrarë katër protestues te opozitës. Ai ka treguar se ne 21 Janar ishte vene ne mbrojtje te institucioneve dhe qytetareve te Tiranes, ndërsa së bashku me deputete te tjerë socialiste dhe drejtues te policisë se Tiranës, ishin angazhuar ne largimin e turmës, pasi kishin pare se Garda kishte nisur te qëllonte me arme luftarake. I pyetur ne lidhje me praninë e te pandehurit Agim Llupo ne ambientet e Kryeministrisë, ish-kreu i Policisë Bashkiake deklaroi se fillimisht kishte dyshuar se mund te kishte qene ai, por me pas këtë e kishte verifikuar nëpërmjet medias. Ndërsa dëshmitari i dyte qe dha shpjegime para Gjykatës ishte Erald Bisha, i cili gjate protestës mbeti i plagosur. Dëshmitari tha para Gjykatës se plumbat i kishin ardhur nga Kryeministria, pa qene ne gjendje te shquante se kush e kishte qëlluar.<br /><br />Guard has exceeded the powers after shot into the crowd with a weapon of war.
