SHERBROOKE, CANADA — A waiter was arrested for serving salmon to an extremely allergic customer on Wednesday in case that could be a first for Canada, according to CBC News.

Simon-Pierre Canuel filed an official complaint against Le Tapageur restaurant after he almost died from his experience there, according to CBC News.

The waiter could be charged with criminal negligence, reports CBC News.

At the May 29th incident, Canuel ordered beef tartare and told the waiter he was severely allergic toward salmon and seafood, said Sherbrooke police Const. Martin Carrier.

“At the time of the order, the waiter took no notes and never went to the kitchen to talk with the staff,” Carrier said.

When his food arrived, Canuel took a bite of his food. He soon realized he wasn’t eating beef and informed his partner, who is a resident doctor, according to CBC News.

“He confirmed that it was salmon and he said we had to go to the hospital. We told the waiter, who apologized, saying he would bring me beef,” Canuel recalled.

“That’s when I started going into anaphylactic shock and having difficulty breathing.”

Canuel has left his EpiPen in the car.

He had to be hospitalized in the intensive care unit, where he was treated for a severe allergic reaction.

To make matters worse, he also suffered a heart attack the next day and was in a coma for several days.

Authorities arrested the 22-year-old waiter this week, according to CBC News. He was released and is scheduled to appear in court.

Canuel alleges that the waiter didn’t inform the kitchen of his allergy and was instead talking and drinking alcohol with other guests.
