Following the arrest of Treasury CS Henry Rotich his PS Kamau Thugge and 28 others over procurement illegalities in the awarding of the dam tender.<br /><br />Below is a list of the charges the 28 are facing.<br />Intention to defraud which is against section 317 of the Penal Code, Cap 63 of the Laws of Kenya.<br />Intentionally failing to comply with procurement procedures which is against section 45 (2) (c) and section 48 of Anti-Corruption and Economic Crimes Act No. 3 of 2003.<br />Abuse of office which is against section 46 and 48 of the Anti-Corruption and Economic Crimes Act No. 3 of 2003.<br />Engaging in a project before proper planning which is against section 45 (2) (c) and section 48 of the Anti-Corruption and Economic Crimes Act No. 3 of 2003.<br />Being involved in financial misconduct which contravenes section 197 (1) (o) (i) of the Public Finance Management Act no. 18 of 2012.<br />Fraudulently acquiring public property, a crime that goes against section 45 (1) (a) and section 48 of the Anti-Corruption and Economic Crimes Act, 2003.<br />Issuing a misleading document to the principle which contravenes section 41 (2) and section 48 of the Anti-Corruption and Economic Crimes Act no. 3 of 2003 of the Laws of Kenya.<br />Failing to perform an official duty that is against section 128 and section 36 of the Penal Code.
