If you weren't drinking or don't have illegal substances in your system and you're arrested for DUI, that doesn't mean that the case is just going to be dismissed by the prosecutor. If you have some prescriptions in your system and they've taken your blood and those prescriptions have similar effects to those of alcohol, then the prosecutor can proceed on that.<br />So yeah, just because you have prescriptions in your system and you have a valid prescription for those, that does not mean that your DUI is automatically go away. The prosecutor is going to look and see if you were impaired based on any kind of driving pattern or your performance on the field sobriety test. <br />Just because they're legal drugs and you have a valid prescription for them doesn't mean that your DUI is going to go away.<br />If you've been charged with a DUI, time is of the essence.
