Lindsay Lohan was a no-show in court as New York prosecutors decide whether or not to file criminal charges against the actress after an altercation in a nightclub.<br/> <br />Lohan was arrested in November on an assault charge after police said she punched a fortune teller in the face.<br/> <br />The starlet's attorney, Mark Jay Heller, says Lohan didn't hit anyone.<br/> <br />SOUNDBITE: Mark Jay Heller, attorney, saying (English):<br/> <br />"I am confident that they will determine as I did that the alleged victim in this case was simply seeking her 15 minutes of fame, and that's why these charges were lodged."<br/> <br />And Heller is confident the case will be dismissed.<br/> <br />SOUNDBITE: Mark Jay Heller, attorney, saying (English):<br/> <br />"It's my opinion that this case will ultimately be declined for prosecution, but it will be several weeks before the district attorney makes that decision and ironically a psychic fortune teller has predicted that the year 2013 will be an extremely lucky year for Lindsay Lohan."<br/> <br />But while she avoided court in New York, she will have to appear at a probation violation hearing on January 15 in California.
