  • Release Date: 1983-05-18
  • Genre: Law

Description

These are appeals from convictions for rape (Cause No. F-79-5690-JP) and aggravated rape (Cause No. F-79-6542-HP). The cases were tried together. The jury assessed punishment at confinement in the Texas Department of Corrections for ten years and forty years, respectively. The appellant asserts in four grounds of error that: the trial court abused its discretion in limiting appellants discovery of medical reports; the trial court erred in denying appellants motion for mistrial based on the prosecutors improper jury argument; the trial court erred in denying appellants motion for mistrial based on the prosecutors improper have you heard questioning; and the evidence was insufficient to prove that the rape in Cause No. F-79-6542-HP was aggravated.
